As Department Commander I am declaring the suspension of WA AMVETS Post 69 null and void from it's inception, therefore, all business transacted by WA AMVETS Post 69 since the day of the hearing (Sept. 9, 2006) has been done so legally and WA AMVETS Post 69 is not now and has not been suspended.  This has been done following a formal ruling from the WA Dept JA which you will find included in this e-mail.

Subject: SUSPENSION OF A POST

Commander:

I have reviewed APPENDIX A: REVOCATIION, CANCELLATION OR SUSPENSION OF POST CHARTERS of the National Bylaws and have come to the following conclusion and ruling.

1. The action taken at the Department Executive Committee meeting at Sunnyside, Washington on 9 September 2006, suspending the Charter of Post 69 DID NOT follow the proper procedure (specifically Section 4 of the appendix) to notify the post of the charge and the intent to suspend the Post Charter.

2. As the Department Judge Advocate I am therefore ruling that the decision of the Department Executive Committee suspending the charter of Post 69 was out of order and is considered NULL and VOID.

The status of Post 69 is restored to its pre DEC status and all business conducted by the post, that conforms to National, Department and Post Constitutions and Bylaws are deemed to be legal actions.
